Iowa’s Stand-Your-Ground law was passed in 2017, and it removed the requirement to retreat from a violent attacker before we can take defensive action. But the law has gaps.
HF-668, filed by Rep. Wengryn, would change all of that in several important ways:
1. Granting gun owners the presumption of innocence following a shooting
2. Allowing gun owners to assert Stand-Your-Ground in a pretrial hearing
3. Requiring there to be probable cause before a gun owner could be arrested
4. Covering the threatened and actual use of force
Until these gaps are filled, Iowans can be prosecuted by liberal county attorneys who are pursuing a political agenda, not justice. Thankfully, HF-668 has been referred to the Judiciary Committee, and a hearing could happen soon.
