SUMMARY

Universal background checks make it a crime for gun owners to buy, sell, or give away firearms to anyone, even members of their immediate family, without first going through a federal NICS check. But a NICS check creates a paper trail that the FBI can use to track gun owners.  Further, almost every mass shooting of the last fifteen years was carried out by a murderer who passed or bypassed  these checks. They are worthless at stopping violent crime.

SUMMARY

SAPA legislation is based on a constitutional principle that has been upheld by the U.S. Supreme Court multiple times, called anti-commandeering. It is the idea that the feds can’t commandeer the resources of our state to enforce federal law. SAPA law is designed to protect law abiding Iowans from federal tyrants, by asserting the state’s right to not allow our cops to enforce federal gun laws. It is not a Supremacy Clause violation because SAPA doesn’t limit what the federal government can do in Iowa. It simply says that Iowa cops won’t help them do it. SAPA has passed in Missouri (2021) and has survived court challenges.

SUMMARY

Iowa has had Stand-Your-Ground (SYG) law in place since 2017. Despite this, gun owners in Iowa are presumed guilty in any use of force situation. In almost 20 other states, gun owners are presumed innocent until the state proves their guilt in court. More, in these states, gun owners can’t be arrested without probable cause. And in many of them, gun owners can assert SYG in a pre-trial hearing. In Iowa, SYG protections don’t take effect until the appellate process.

“ASSAULT WEAPONS” BAN LEGISLATION

SUMMARY

Gun Grabbers at all levels of government have been attempting to ban “Assault Weapons” and limit ammo capacity for decades. They have no definition of “Assault Weapon.” If it looks scary to them, they want to ban it. Banning “Assault Weapons” isn’t about reducing violent crime, it’s about controlling what weapons Iowans have access to: for self-defense,  for hunting, for sport shooting, and most importantly for holding our own government accountable to “We the People.”

ANTI RED FLAG GUN SEIZURE LEGISLATION

SUMMARY

Red Flag Gun Seizure legislation allows gun owners to have their firearms and ammunition confiscated through judicial orders before they’ve been charged, let alone convicted, of a crime. Federal legislation enacted in 2022 allows Joe Biden to bribe states into passing these ‘Red Flag’ laws with $750,000,000 worth of taxpayer money.

Chairman Holt, Representative Klein, and Representative Wessel-Kroeschell, on behalf of the members of Iowa Gun Owners I would like to express our support for House Study Bill 254, especially the sections dealing with Constitutional Carry law and the phase out of Iowa’s permit to acquire pistols and revolvers. The members of this sub-committee are well aware of what Constitutional Carry is, so I will just quickly summarize our member’s support for this crucial piece of legislation. HSB 254’s Constitutional Carry provisions would make Iowa’s existing ‘Shall Issue’ laws optional for law-abiding gun owners, and allow them to carry a firearm for any lawful purpose without being forced to pay fees, obtain government permission, or add their name to a state or federal database. The members of Iowa Gun Owners did their jobs last fall and rejected anti-gun candidates up and down the ballot. Besides defeating Joe Biden, gun owners threw Abby Finkenauer out of Congress and kept J.D. Scholten, Rita Hart, and Theresa Greenfield out of office -- while increasing the size of the GOP’s majorities in the Iowa legislature. Overview:

Rep. Bruce Hunter’s H.F. 24 (Red Flag Gun Seizure legislation) is full of unconstitutional constructs that are damaging to the Second Amendment as well as fundamental (and centuries old) judicial concepts like ‘innocent until proven guilty’ and basic ‘due process’ rights.
