Iowa: SF-2128 would punish gun owners for crimes committed by criminals

Things are changing quickly here in Des Moines.

For close to a decade, Iowa Democrats barely talked about gun control. During this time Iowa Gun Owners passed major victories like Constitutional Carry, Stand-Your-Ground law, and the Freedom Amendment.

It was a great run, but the political environment is shifting.

National Democrats are convinced they are going to flip the House. Here in Iowa, many are concerned that Rob Sand could become our next Governor. And that’s firing up Democrats.

So on the one hand, we are advancing pro-gun legislation like HF-2718 — a bill to ban Red Flag Gun Seizures here in Iowa.

But at the exact same time, Democrats in Des Moines are making their goal of disarming law abiding Iowans more obvious than ever.

That’s why Senator Art Staed has just filed SF-2128legislation that would make gun owners civilly liable if a criminal steals one of our firearms and uses it in a crime years later.

You read that right.

If a violent criminal breaks into your home or vehicle, steals your firearm, and later uses it in a crime, you or I could be drug into court and sued.

Under SF-2128, gun owners could be forced to pay for:

👉 Emotional distress claims caused by the criminal
👉 Physical injuries caused by the criminal
👉 Property damage caused by the criminal
👉 Even the other side’s legal fees

In other words, instead of holding violent criminals responsible for their crimes, this bill would make gun owners responsible for what criminals do.

No sane legal system works that way.

But that’s exactly what this bill would do.

And there is another serious problem developing in the Iowa Senate.

If you’ve been watching the news out of Des Moines this session, you know that Senate leadership is in chaos. Conservative senators are being pulled off committees and publicly scolded by Senate Majority Leader Mike Klimesh.

At the same time, pro-gun legislation keeps getting bottled up.

Last session, HF-945 — legislation to strengthen Iowa’s Stand-Your-Ground law — passed the House by a vote of 89-6.

But Senate Judiciary Chairman Jason Schultz personally killed that bill in committee.

This same thing is happening right now to HF-2718, the bill to ban ‘Red Flag Gun Seizures’ in Iowa.

And now SF-2128 has been referred to Schultz’s Judiciary Committee, where the bill has already been assigned to a subcommittee.

That means gun owners need to get very loud right now.

Every petition we generate reminds politicians in Des Moines that gun owners are paying attention — and that we expect the Iowa Senate to do its job.

Things are changing fast here in Iowa.

The Democrats are fired up again, and the turmoil inside Senate leadership has created a dangerous environment where bad legislation could move if gun owners aren’t paying attention.

That’s why we need to flood the Capitol with grassroots pressure right now.
