Iowa: Running Out of Time to Pass SAPA!

We are down to the wire here in Des Moines.

While the end-date of the General Assembly is not clear at this point as negotiations over the budget and school choice legislation drag on, it will almost certainly be in April.

That means that we only have a couple weeks left to force the legislature to take action on the Second Amendment Preservation Act (SAPA) (H.F. 2303/S.F. 2002) — before it’s too late!

So please read this update so you know what’s going on and then sign your petition, demanding that Senate Majority Leader Jack Whitver and House Majority Leader Matt Windshitl stop blocking this badly needed legislation.

Thanks to the support of IGO members from across the state, SAPA got off to a roaring start this session.

In the House, almost 20 lawmakers cosponsored IGO’s SAPA legislation, while the Senate passed the identical bill through a Judiciary subcommittee in late January!

Despite this, House leader Matt Windshitl is refusing to allow SAPA to even be heard in sub-committee while Jack Whitver is refusing to allow a floor vote in the Senate.

And while they intentionally try to stall this bill, Joe Biden’s Executive Orders are now just months away from making felons out of countless gun owners here in Iowa!

The White House has recently announced that in June, the ATF will begin enforcement of Joe Biden’s Executive Order banning the possession of an unregistered homemade firearm, otherwise known as an ‘80% lower.’ 

These are wildly popular homemade firearms that Iowans enjoy from river-to-river. In June, owning these firearms will leave you facing a felony unless you get it registered.

And if that isn’t enough, in August, the ATF will begin to charge gun owners with felonies for owning a pistol brace! These braces make firearms more controllable and there are between  10-40,000,000 of them in circulation across the country.

Remember, these are the Executive Orders of a desperate President who can’t pass gun control through the Senate. That means that neither of these orders were passed by Congress, but that doesn’t mean you and I won’t be facing criminal charges!

That’s why the politicians in Des Moines need to enact SAPA legislation before they adjourn! You see, Biden is counting on

Iowa cops to enforce these Executive Orders as the federal government doesn’t have the manpower to do it themselves.

But if Iowa follows Missouri’s lead and passes SAPA, Iowa cops will be instructed to only enforce Iowa laws when it comes to firearms, ammunition, and accessories — ignoring federal gun control laws and Executive Orders all together!

In other words, Biden’s war on gun owners would fall flat on its face here in Iowa as it would simply go unenforced.

House and Senate leaders are throwing up multiple excuses about why we can’t pass SAPA here in Iowa, arrogantly trying to confuse gun owners who are tired of their inaction. Here’s the facts that the politicians in Des Moines aren’t telling you.

Excuse #1: We can’t pass SAPA as it’s unconstitutional. Reality: SAPA and the idea of state sovereignty has been upheld in the United States Supreme Court for hundreds of years!

Excuse #2: We can’t pass SAPA; law enforcement opposes it. Reality: The Carroll County attorney has publicly endorsed SAPA, urging the legislature to pass it before it’s too late!

Excuse #3: We can’t pass SAPA; blue cities will ignore it. Reality: IGO’s SAPA legislation has $50,000 civil fines built into it. Any agency that violates SAPA can be taken to court by the individual gun owner for damages! SAPA will be obeyed!

Excuse #4: We can’t pass SAPA until Missouri’s law is upheld in court. Reality: Missouri’s SAPA law was challenged by the DOJ in Circuit Court last fall…and the law was upheld!

The Iowa legislature clearly has the Constitutional and legal right to pass SAPA and protect gun owners from the attacks that Joe Biden is bringing to our door. But for this to happen, Matt Windshitl and Jack Whitver need to stop blocking the bill!
